Abstract

Results of system analysis of statutory wording and evidentiary disclosure of intentions of Regulators (state and corporate) that govern the chemical process safety in the legal / administrative field are presented. It has been noted that the legal nomenclature of notions in place for safety control and management automation purposes is not completely adequate. In order to deal with practical challenges in the field of control and management of safety risks of designed and operating chemical processes on the basis of digital tools by bringing a physical sense to legal and administrative terms (including clarification of the link between safety and risks), the basis of the conceptual apparatus in the field of safety for engineering and operating that properly conform to legal one is developed. The undoubted usefulness of the approach presented to practitioners can be seen in the example of specification of pan-process “declaratory” safety objectives into processspecific auditable “production” ones.

Abstract

The article presents the results of research on ensuring the reliability of ethane-containing gas supplies to gas processing and gas chemical complexes over the years, taking into account uncertainty in gas production volumes and the content of valuable components in it from various sections of gas condensate fields in the Nadym-Pur-Taz region of Western Siberia.

Abstract

An analysis of civil defense risks caused by increasing damage from hazards arising from military conflicts and military operations was carried out and an approach to managing these risks was systematized. Particular attention is paid to regulatory legal acts adopted in 2023-2024, which are aimed at increasing the efficiency of regulating these risks. Measures are considered to ensure the safety of the population and minimize damage.

Abstract

The purpose of the article is to analyze the experience of international cooperation in the field of reducing the risks of natural disasters and man-made disasters, substantiating the prospects for cooperation with friendly countries in the fight against natural disasters and man-made disasters within the CIS, SCO and BRICS, as well as with the countries of the global South in the field of humanitarian activities. Based on a study of the current geopolitical situation and a generalization of the experience of Russia’s international activities in this area, the article proposes areas for further cooperation in the near future.

The long-term dynamics of ocean surface temperature in tropical cyclone zones is compared with the dynamics of a number of characteristics of tropical cyclones. Regression relationships have been identified that determine the long-term dynamics of a number of statistical parameters of tropical cyclones in connection with the variation in ocean surface temperature.

Abstract

The purpose of this article is to identify and formalize the compliance features of creating IT-products in the course of IT-projects. Identification of compliance features was carried out by analyzing the activities of 495 IT-organizations of the Tomsk region and studying of 192 court decisions. As a result of the research, the following compliance features of creating IT-products were set: the transfer of ownership to the IT-product and rights to the result of intellectual activity from the contractor (executor, supplier) to the customer is carried out upon completion of the IT-project; the transfer of ownership to the IT-product and exclusive rights to intellectual property requires documentary support; the process of creating an IT-product by the IT-project team must be formalized according to the rules of a service work; obligatory elimination of compliance risks before the start of an IT-project. In addition, it was found that in order to eliminate the risks associated with infringement of exclusive rights to the result of intellectual activity, collection by the right holder (author) of remuneration for violation of exclusive rights to the result of intellectual activity, prohibition to use the result of intellectual activity, impossibility of recognizing the exclusive right to the result of intellectual activity for the right holder (author), the correct application of the legal mechanism for creating, changing and (or) terminating exclusive rights to the result of intellectual activity is required. It follows that it is needed to start implementing IT-projects only after eliminating compliance risks and fixing the necessary covenants of the transaction in the terms of the contract. The obtained results of the domestic judicial practice analysis showed that failure to comply with this requirement, as a rule, leads to a deviation from the planned project goals, significant material damage, as well as significant reputational costs.
